Weekly Bike RENTAL – PROGRAM AGREEMENT AND POLICIES

 I hereby acknowledge and agree to the following rental agreement terms and conditions:

______Bikes are rented out clean and in proper working condition and must be returned in the same manner.

______Bikes are maintained on a daily basis. It is the responsibility of the client to test the bike at the studio, once bike leaves Ameanspinn premises, customer becomes fully responsible.

______Customer agrees to return the bike in clean, UNDAMAGED condition to avoid any ADDITIONAL charges for repair, maintenance or replacement. Customer accepts use of the equipment, AS IS, in good condition and accepts full responsibility for care of the equipment while under his/her possession. Damaged parts or components will be repaired/replaced at the shop’s discretion and customer agrees to pay regular shop rates and retail prices for components replaced. Clean condition means bringing it back as it was given to you as you accepted but does not include broken crank bar, seat slider, chain guard, damaged frames, handlebars, seats or other parts from misuse and/or damages. Note: All bikes should be returned clean of mud, dirt and debris. Any bike returned with damages is liable for full $1100

AUTOMATIC WEEKY RENEWAL:

AMEANSPINN Home Bike Rental Program will automatically renew each 7 days on the day the membership expires.

This document acts as an agreement and contract for bike rental and payment. Renewals will be billed at $62.50 per week as of the date of your rental enrollment. Your rental agreement will continue to renew automatically until it is cancelled, or until the studio returns to normal operations. The equipment must be returned in the same condition as received. If the equipment is not returned in the condition received, or is not returned within 7 days of termination of the rental agreement, there will be a replacement fee of $1,100 for the equipment/bike.

Termination of Agreement:

In order to terminate this agreement with AMEANSPINN LLC, Members must complete the minimum of 4 automatic weekly payments., after fulfillment is met, if wanting to cancel member must provide 7 days notice in writing via email to cancel or end membership services. (facebook nor Instagram is not a form of cancelation) Customer must send notice to info@ameanspinn and return the equipment to AMEANSPINN at an agreed upon time,  at 11222 Grandview Ave Ste 7 Silver Spring Md 20902 in the same condition that it was given. You may cancel this agreement in writing by sending an email to (Please contact studio to make arrangements of drop off or curb side pick-up) 

Upon notification of intent to cancel, member agrees to be automatically billed for any outstanding account balance connected to the weekly rental program.
This agreement includes self-guided workouts and access to virtual classes led by Ameanspinn instructors.

A non-refundable 1 time registration fee of $89 will be charged to the credit card on file. 

Customer agrees to provide AMEANSPINN LLC with credit card details, for precautionary use only on Mindbody file, customer agrees not remove credit card on file for the weekly autopay program. 

I authorize AMEANSPINN LLC, Indoor Cycling Studio to charge the credit card I have on file for me for all weekly costs in case of damages to the bicycle(s) during my rental period, comprehensive of labour, or total replacement of the bike. In case of theft, I will be responsible for reimbursing Ameanspinn LLC for the original price of the Star Trac NXT 7170 Seri(s), plus the cost of any accessories that were provided at the time of the bike rental.

ASSUMPTION OF RISK, WAIVER AND RELEASE AGREEMENT

Assumption of Risk: I understand and accept that renting this bike and participating in bicycling exposes me/my child to many hazards that may entail unavoidable risk of death, personal injury (including but not limited to severe spinal or head injury) and loss of or damage to property. I also understand I am or should be in good physical health to participate in indoor cycling, and I confirm that I have no significant health issues that prevent me from participating in indoor cycling online classes. I have no medical conditions, nor have I been diagnosed with a condition that prevents me from bicycling.  In spite of the aforementioned risks and acknowledgements, I hereby assume all risk of injury or loss of life to myself and loss of or damage to property arising out of renting this bike and participating in indoor cycling. I understand the inherent risk involved in using this Rental Bike equipment and accept full responsibility for any and all such damage or injury which may result.

Waiver And Release: In consideration of Ameanspinn  Weekly Bike Rental Program, renting me this bicycle, I specifically release and forever discharge Ameanspinn LLC,  Indoor Cycling Studio and its affiliates, officers, agents, and employees from any and all liability or claims for injury, illness, death or loss of or damage to property which I may suffer while renting this bike and participating in indoor cycling. This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death or damage caused by the negligence of Ameanspinn LLC, Indoor Cycling Studio or its affiliates, officers, agents, or employees. It is my intent by the Waiver And Release Agreement to release Ameanspinn and hold it harmless from all liability for any such property loss or damage, personal injury or loss of life, whether caused by the negligence Ameanspinn LLC or whether based upon breach of contract, breach of warranty, or any other legal theory. In signing this document, I fully recognize that if injury, illness, death or damage occurs to me/my child while I am engaged in renting this bike or participating in indoor cycling, I will have no right to make a claim or file a lawsuit against Ameanspinn LLC, Indoor Cycling studio or its affiliates, officers, agents or employees, even if they or any of them negligently cause my injury/my child’s injury, illness, death or damage. 
Bike Inspection.  once we have our equipment and complete our post-delivery inspection. we will if need it, deduct costs for repairs and cleaning beyond normal wear and usage or determine the bike damaged.

REPAIR FEE. If a Bike is damaged during the Rider’s use of the Bike, beyond regular wear and tear such as a handlebar tightening and seat adjustment, and a result of negligent or misuse or intentional conduct on the part of the Rider, the Rider shall be charged a fee that is equal to the cost of repairing such damage.
Ameanspinn may charge the Rider a replacement cost equal to $1,100.00.

The Rider agrees…

_______I realize the importance of wearing proper cycling shoes. Cycling Shoes must be worn at all times. Or hard sole shoes to protect the bike from damage.

_______I understand that there are no bicycle lanes in Perth, ON. 

_______Ameanspinn & Rentals staff have answered any questions I have had.

_______I understand these bikes do not have cadence meters and shall not be attempted to attach to the bike from myself.

I HAVE CAREFULLY READ THIS AGREEMENT IN ITS ENTIRITY AND UNDERSTAND ITS CONTENT. I AM AWARE THIS IS AN ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY AND I SIGN IT VOLUNTARILY. I ALSO UNDERSTAND THAT I SHOULD NOT AND MAY NOT PARTICIPATE IN THIS ACTIVITY IF I AM UNDER THE INFLUENCE OF ALCOHOL OR DRUGS.
